I do believe Edwards was disbarred some years ago.

I also do believe the LA Supreme Court has decided several years ago that a disbarred lawyer may not be employed by a law firm in ANY capacity. Not ever to sweep the floors.

It will be interesting to see how this plays out -or if it does play out.

Personally, I'm glad to see him back under any circumstances. I think a lot of people think he got a raw deal and if old friends want to help him out, especially at their expense, then all the better.

Here is another issue that is unclear: if the first spouse dies with the exemption is $5 million, does he or she get the full exemption or just the amount of the estate reported on the return? In other words, if somebody dies in 2011 with a $1 million estate and a return is filed claiming the "unused exemption", does that mean $1 million or $5 million goes to the surviving spouse?

Yes, good point.

The IRS will be swamped with 706 returns to satisfy the weak legislation that Congress has foisted on us.

I will probably do something along the lines that you are suggesting.

As a lawyer, I think I would be inclined to get some software to cookie-cutter basic estate tax returns for small estates. The purpose would simply be to make the election for the exemption and nothing else. The \"nothing else\" would be made clear to the client and I would be able to charge a much smaller fee.
