I also do believe the LA Supreme Court has decided several years ago that a disbarred lawyer may not be employed by a law firm in ANY capacity. Not ever to sweep the floors. In other words, if somebody dies in 2011 with a $1 million estate and a return is filed claiming the "unused exemption", does that mean $1 million or $5 million goes to the surviving spouse? The purpose would simply be to make the election for the exemption and nothing else. The \"nothing else\" would be made clear to the client and I would be able to charge a much smaller fee.
