Step parent adoption.

If the ex is not on board - what are the rules?  Ex cannot visit by court order and is not paying child support - going on 2 years.

Failure to pay for at least 2 years is one aspect. It sounds like there would be no objections on the father's part to an adoption action.

step parent has to have been married to the parent for at least 6 months; father has to be notified of the proceedings per the usual legal standards and has the right to appear and contest the proceeding. I think the preponderance is given to the potential adoptive parent if the dad isn't paying support -- assuming there is a support order in place.

Proposed step-parent must be married to mom or dad - they have to have lived together (not necessarily married) 6 months prior so step parent had physical custody of child for 6 months - if no support or contact from other parent for six months - that person has waived their right to object.

The bio parent still has to be notified. If not, then there is grounds for appeal and it gets expensive and messy. Better to take the conservative route....notify.
