I bought a piece of property that adjoins property that I already own. The property that I already owned, as well as the piece I bought, both connect to river batture acreage. I bought the batture property with both pieces of land. On the property that I recently bought, the previous owner maintained mineral rights for the batture for five years. I am now in negotiations with a company to come on to my batture (a five year lease), and pump sand out of the river to use for thier road building projects. Is sand mineral. And even if it is, they will be taking the sand from the river, not the batture. It will be stored on the batture, but not taken from it. Do you see this being a problem? Thanks for your time.

This area of law is extremely narrow and there have been some recent legislative changes in the area. You would really need to sit down with a lawyer who has experience in this field.
