Boyfriend is certain he is not the father, but mother is talking about some day suing for paternity.  (He was in Iraq, a medical impossibility)  Can boyfriend file with the court to order baby and him DNA tested?  Does he have to wait for the Mom to file suit against him?  He'd like to not have this hanging over his head and get it resolved now.

he can go to support enforcement services (child support) and ask them to take care of getting the testing done. He does not have to wait for the mom to file suit, but why worry about it? Most of the time this is ony an idle threat when the mom knows that someone is not the dad. Just sit back and wait for her to take action, it may never even happen. (the guys may have a different answer for this........but honestly, nothing is 'hanging over his head', she hasn't done anything and if he knows he is not the dad, why worry? unless.......he thinks he MAY be? babies have been known to be very early, and very late....)

I would go ahead and go to SES and request the testing. After all airplanes fly all over the world every day and he may be faced in years to come with having to come up with proof he didn't come home on leave etc.

Thanks, guys!  I"ll pass this on and let him decide.  He was away for over a year - so he knows its not his, but would rather the issue be closed.

or put him on that show where they do the DNA testing.   I love to see the moms crushed when none of the five or six men they named are the dad.

My nephew had doubts about a child being his.  He picked her up for visitation, gave mom money for several months, etc.  Then one day, having gained mom's trust, picked up the child, took it to a doctor appointment and the testing was done.  When the results came back, mom was angry but had very little to say after the fact.
That was in another state, but, when the going gets tough.....
