Local bank filed a proof of claim in my father’s succession. Before his death, he had been battling with bank for years over this dispute. It was filed three years ago in his succession. Succession was never closed with Judgment. Minimal assets were divided as per the last will after letters testamentary were issued to indep. executor. All but one legatee is now deceased. Should living legatee be concerned?
Father was a stickler for keeping records and never owed anyone a dime – papers filed as exhibit with proof of claim were shown to a successions attorney who stated that they didn’t prove anything was owed or that money was ever distributed to decedent.
